NotesBot is a Discord bot that provides voice listening, transcription, and AI-powered summarization services for Discord voice channels. The Service includes:

• Listening to Discord voice channel conversations
• Transcribing audio to text using AssemblyAI
• Generating summaries using OpenAI's GPT-4
• Processing and managing audio and transcriptions
• Subscription-based access to premium features

3. User Requirements

3.1 Age Requirement

You must be at least 13 years old to use NotesBot, in accordance with Discord's Terms of Service.

3.2 Discord Account

You must have a valid Discord account in good standing to use our Service.

3.3 Consent for Audio Capture

You are responsible for obtaining consent from all participants before capturing any conversation. By using NotesBot to listen, you represent and warrant that all participants have been notified and have consented to the audio capture.

4. Acceptable Use Policy

You agree not to use NotesBot to:

• Violate any laws or regulations
• Capture conversations without proper consent
• Harass, abuse, or harm others
• Upload or transmit malicious content
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Service
• Use the Service for any illegal or unauthorized purpose
• Violate Discord's Terms of Service or Community Guidelines

5. Subscription and Payment

5.1 Subscription Plans

NotesBot offers various subscription plans with different features and usage limits:

• Basic: $3/month (5 hours)
• Standard: $5/month (10 hours)
• Pro: $15/month (30 hours)
• Premium: $20/month (40 hours)
• Ultimate: $40/month (100 hours)

5.2 Payment Processing

All payments are processed securely through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis.

5.3 Refunds

Subscription fees are non-refundable except where required by law. You may cancel your subscription at any time, and you will continue to have access until the end of your billing period.

6. Intellectual Property

6.1 Your Content

You retain ownership of all content you create using NotesBot, including recordings and transcriptions. By using our Service, you grant us a limited license to process and store your content as necessary to provide the Service.

6.2 Our Property

The NotesBot service, including all code, design, and documentation, is owned by us and protected by intellectual property laws.

7. Privacy and Data Protection

Your use of NotesBot is governed by our Privacy Policy. We are committed to protecting your privacy:

• We do NOT store your conversations, recordings, or transcriptions
• Audio is processed in real-time and immediately deleted
• We only retain basic account and subscription information

8. Disclaimers and Limitations of Liability

8.1 Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. The Service is provided “as is” and “as available.”

8.2 Accuracy of Transcriptions

While we use advanced AI technology, we do not guarantee 100% accuracy in transcriptions or summaries. Users should review and verify important information.

8.3 Third-Party Data Handling

We are not responsible for how third-party services (AssemblyAI, OpenAI) handle your data once it leaves our systems. These services may store, process, or use your data for their own purposes, including but not limited to model training and improvement.

8.4 Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service.

9. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of the Service, violation of these Terms, or violation of any rights of another party.

10. Termination

We reserve the right to terminate or suspend your access to the Service at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users or the Service.

11. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.
